DMCA & Copyright Compliance Policy

AnimeSail respects the intellectual property rights of animation studios, manga publishers, and content creators. We maintain strict compliance with the Digital Millennium Copyright Act and international copyright conventions.

Informational Directory Notice: AnimeSail (animesail.net) is strictly an online search directory and index of legal media availability. AnimeSail does not host, upload, rip, store, or stream any copyrighted video files on its servers. All outbound watch links route visitors exclusively to authorized global distributors (Crunchyroll, Netflix, Hulu, Disney+, Prime Video).

1. Safe Harbor Status Under 17 U.S.C. § 512(d)

Under Title II of the Digital Millennium Copyright Act (17 U.S.C. § 512(d), Information Location Tools), service providers that refer or link users to an online location containing infringing material or infringing activity by using information location tools, including a directory, index, reference, pointer, or hypertext link, are entitled to statutory safe harbor protections provided they expeditiously remove or disable access to the reference or link upon receiving proper notification.

AnimeSail operates in full accordance with these safe harbor limitations. We do not exercise editorial control over third-party distributor servers, nor do we derive direct financial benefits from any infringing activities of third parties.

2. Designated Copyright Agent Information

Pursuant to 17 U.S.C. § 512(c)(2), AnimeSail has designated an agent to receive notifications of claimed copyright infringement. Formal copyright notices should be directed to:

AnimeSail Designated Copyright Agent

Attn: Legal & Copyright Compliance Department

Email: [email protected]

Subject Line: "DMCA Takedown Notice - [Anime Title]"

Processing SLA: Verified notifications processed within 24 to 48 business hours.

3. Requirements for Submitting a Valid DMCA Notice

To ensure your notice can be investigated and acted upon promptly, 17 U.S.C. § 512(c)(3)(A) mandates that a notification of claimed infringement must be a written communication containing the following six statutory elements:

  1. Authorized Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed (e.g., Japanese anime series name, episode number, registration number, or studio production committee credentials).
  3. Exact Location on animesail.net: Identification of the material claimed to be infringing or to be the subject of infringing activity, including the specific, exact URL on animesail.net where the indexed listing is located (e.g., https://animesail.net/anime/example-slug/).
  4. Complaining Party Contact Details: Information reasonably sufficient to permit AnimeSail to contact the complaining party, such as a full legal name, physical address, telephone number, and official corporate email address.
  5. Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Notice Processing Workflow & Removal Protocol

Upon receipt of a substantially compliant DMCA notice meeting the criteria outlined above, AnimeSail takes the following actions:

  • Acknowledge receipt of the notification within 24 business hours.
  • Conduct an immediate verification of the referenced URL to assess the nature of the referenced metadata or external link.
  • Expeditiously remove or disable access to the disputed metadata index entry or external link if found non-compliant with our legal indexing standards.
  • Maintain detailed audit records of all resolved copyright notices in our compliance registry.

5. Counter-Notification Procedure Under 17 U.S.C. § 512(g)

If you believe that metadata or an outbound link was removed or disabled as a result of mistake or misidentification (e.g., where a content license was improperly challenged), you may submit a counter-notification to our designated agent pursuant to 17 U.S.C. § 512(g)(3). A valid counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and the URL at which the material appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your legal name, physical address, and telephone number, and a statement consenting to jurisdiction of Federal District Court for the judicial district in which the address is located.

6. False Claims & Misrepresentations (17 U.S.C. § 512(f))

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer or service provider injured by such misrepresentation. Please seek independent legal counsel before filing a notice.

7. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i)(1)(A), AnimeSail maintains an explicit repeat infringer policy. We reserve the right to permanently block, ban, or terminate the access of any user, contributor, or partner who repeatedly submits infringing materials or abuses our indexing platform.

8. Fair Use Doctrine Notice

Portions of content featured on AnimeSail (including thumbnail art, titles, character names, and brief descriptive synopses) are displayed under the Fair Use doctrine (17 U.S.C. § 107) for transformative purposes of criticism, commentary, scholarship, news reporting, and discovery directory indexing. This informational usage does not supplant the commercial market for original licensed streaming.
